Terms & conditions

These Terms & Conditions govern the use of insulatercera.com and purchases made through the Insula Tercera online store. By placing an order, the customer agrees to these Terms and to the Returns & Exchanges and Privacy policies.

1. SELLER IDENTIFICATION

The Insula Tercera online store is operated by SOREMA, S.A., a Portuguese company with registered office at Rua dos Limites, no. 145, 4500-486 Espinho - Silvalde, Portugal, company registration and tax number 500 419 280.

2. PRODUCTS

We endeavour to present descriptions, compositions, colours, dimensions and images accurately. However, colours may vary depending on the screen used. As our products are made from natural fibres using textile processes, some items may show slight variations in colour, texture and dimensions between batches. Where stated on the product page, minor residual shrinkage may occur after washing.
Images are for illustrative purposes and do not replace the product characteristics, measurements and care instructions provided on each product page.

3. PRICES AND PROMOTIONS

Prices are shown in the selected currency and include legally applicable taxes where required. Shipping costs, any customs duties and other charges are shown or identified before the order is confirmed whenever they can be calculated at that stage.
Promotions, discount codes and offers are subject to the stated period, market, stock availability and specific conditions. Unless expressly stated otherwise, they cannot be combined or exchanged for cash.

4. ORDERS AND PAYMENT

Adding products to the shopping bag does not reserve them. Before completing an order, the customer must check the items, quantities, personalisation details, addresses and total price.
After purchase, a confirmation will be sent to the contact details provided. The contract is concluded when the order is accepted and payment is validated. We may refuse or cancel an order in the event of unavailability, an obvious pricing or description error, suspected fraud, inability to deliver or breach of these Terms. If payment has already been made, the corresponding amount will be refunded. Available payment methods are displayed at checkout and processed by secure service providers.

5. AVAILABILITY AND PERSONALISATION

All orders are subject to availability. Personalised or made-to-measure items enter production once the request has been validated and may require a longer preparation time than items in stock. The customer is responsible for carefully checking initials, spelling, colours, measurements and all other options before completing the purchase.

6. DELIVERY

Delivery options, costs and estimates are shown at checkout or on the product page. Delivery times are estimates and may be affected by personalisation, availability, destination, the carrier, periods of high demand, customs procedures or circumstances beyond our control.
The customer must provide a complete address and ensure that the order can be received. For international deliveries, the customer may be responsible for customs duties, import taxes or local formalities not included in the price, unless expressly stated otherwise.

7. RETURNS AND RIGHT OF WITHDRAWAL

Where applicable, consumers may exercise their statutory right of withdrawal within the legal period without giving a reason, without prejudice to the 30-day commercial return period offered by Insula Tercera. The exercise of this right and all returns are governed by the Returns & Exchanges page.
Under applicable law, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised, among other statutory exceptions.

8. CONFORMITY AND GUARANTEE

Products are intended to conform to the contract and the information provided. In the event of a lack of conformity, consumers benefit from the rights established by applicable law, including, where legally appropriate, having conformity restored, receiving a price reduction or terminating the contract.
Damage resulting from misuse, normal wear and tear, failure to follow care instructions, accidents or alterations made by the customer does not constitute a lack of conformity attributable to Insula Tercera.

9. INTELLECTUAL PROPERTY

The website and its contents - including trademarks, names, texts, photographs, videos, graphics, patterns, designs and software - belong to SOREMA, S.A. or are used with permission. They may not be copied, modified, distributed or used commercially without prior written consent.

10. COMPAINTS

Customers may submit a complaint through the Contact page or through Portugal's Electronic Complaints Book, available at www.livroreclamacoes.pt.
Consumers may also refer a dispute to a competent alternative consumer dispute resolution body. The current list is available on the Consumer Portal at consumidor.gov.pt. Use of these mechanisms does not affect the right to take legal action before the courts.

11. APPLICABLE LAW

These Terms are governed by Portuguese law, without prejudice to any mandatory consumer protection rules applicable in the customer's country of residence. Any dispute will be submitted to the competent courts in accordance with the law.
